It outlines the core non-waivable rights, rescission and damages remedies, and the growing role of courts and regulators in responding to predatory practices that target vulnerable consumers.
“Unjust Enrichment and Oppression” uses a business break-up scenario to illustrate how unjust enrichment operates when formal shareholdings do not reflect real-world contributions to a venture or asset. It shows how courts balance enrichment, corresponding deprivation and juristic reason, and how equitable remedies can adjust ownership or payout outcomes where strict corporate rules would otherwise produce an unfair result.
Taken together, the session gives litigators a practical overview of how consumer-protection statutes and unjust enrichment principles can be deployed to resist abusive contracts and pursue more equitable resolutions in commercial disputes.
