Waterloo Region District School Board” showcases how Ontario’s anti-SLAPP provision under section 137.1 of the Courts of Justice Act empowers courts to dismiss strategic lawsuits that threaten public expression while preserving meritorious defamation claims against a school board chair’s remarks and social-media posts characterizing a delegation as transphobic. Attendees learn how to craft an effective anti-SLAPP motion that balances freedom of speech with protection of reputation.
Josh Laplante uses the Jackson v. Rosenberg decision to illustrate how the Ontario Court of Appeal applies joint-tenancy and resulting-trust principles to honor a donor’s exclusive intention to confer survivorship rights and confirms that unilateral severance can revoke that gift. This session underscores the importance of precise estate-planning advice, clear transfer documentation and awareness of probate-avoidance risks.
