Tax Audit Management and Consequences of Keeping Poor Records is a practical presentation by Keith Trussler, a lawyer at McKenzie Lake Lawyers LLP and represents taxpayers challenging adverse tax reassessments. The presentation examines CRA audit management, responses to requests for information, and the consequences of inadequate books and records. It reviews the Income Tax Act framework for record keeping, CRA’s strengthened audit powers, communication with auditors, and the importance of documenting transactions that support taxable income. Case law including Poce, Buday, Hans, Fuhr, and Encore Cellular illustrates how poor records, commingled accounts, unsupported expenses, and weak documentation can affect reassessments, penalties, credibility, and the use of alternative assessment methods, while also showing how well-maintained records can help taxpayers respond to audit challenges.
