How do I Arbitrate?; Pure Economic Loss & Maple Leaf Foods

Paula Puddy, HBA LLB MBA

The County of Carleton Law Association presents this two part webinar on the ins-and-outs of arbitration and the Supreme Court of Canada’s split decision on Maple Leaf Foods regarding pure economic loss.

Alexander Gay starts the presentation by covering the ABC’s of arbitration, including rules around document production, the usefulness of confidentiality clauses, advice about the allocation of costs, and the importance of equality and fairness while conducting an arbitration.

Anne Tardif analyzes the Supreme Court of Canada’s 5-4 decision on Maple Leaf Foods case. She highlights the distinction between personal injury and property damage, as well as how the Maple Leaf Foods decision arguably goes further in cementing a rights-based approach to claims for pure economic loss.
