Selling a Polluter Property; Real Property Limitations & Private Mortgages; CPL Certificates; Planning Act Statements

This four-part County of Carleton Law Association (CCLA) seminar is presented by Anand Srivastava, Simon Ashby, Frank Bourgault, and Sid Troister. Join these experts as they discuss various topics related to Real Estate and Environmental Law. 

Anand Srivastava provides updates on the state of Environmental Law in Ontario. He explains the polluter pays principle, examines the Hamilton Beach case, and expresses the need for purchasers to be aware that the responsibility for contamination is not limited to the polluter.

Next, Simon Ashby discusses the Real Property Limitations Act, and its effect on mortgage enforcement actions. He explains when the limitation period starts to run, the no discoverability provision in the RLPA, and examines recent jurisprudence.

After, Frank Bourgault explains the legal landscape surrounding property transactions in Ontario, and discusses Certificates of Pending Litigation (CPLs), and other title restrictions. Frank Bourgault shares the ins and outs of the different types of Cautions, and how and when Section 118 restrictions apply.

Lastly, Sid Troister provides his expertise on the Planning Act Statements. He explains stipulated consent, what happens on the death of a joint tenant, the effects of a cancellation certificate, and how to register a partial discharge.
