  • “Ethical Advocacy: The overarching theme of my presentation will be 'be prepared'. When lawyers are prepared, they are in a better position to practice with civility and treat the participants in the criminal justice system with courtesy and respect.
  • Ethics and Professional Responsibility: During the course of the solicitor/client relationship, lawyers come to learn a lot about their clients. Some of the information that they gather can be mitigating on sentence. That said, lawyers need to be mindful of their duty to maintain confidentiality. When discussing sentencing and sentencing submissions, I will speak about getting the client's instructions before disclosing personal information to the crown and/or in open court.
  • Ethics and Professional Responsibility: During sentencing proceedings, counsel make submissions based on information provided by the client. They also often provide documents to the court such as employment letters and character reference letters. During my presentation, I will highlight that the duties relating to advocacy, and in particular the duty not to mislead the court, apply. Counsel need to satisfy themselves that the information they are providing to the court is accurate. This might involve contacting the authors of letters to ensure that they are legitimate or checking secondary sources (all with the client's consent, of course).”

The Honourable Karen Erlick

Justice Erlick received her Bachelor of Commerce from Queen’s University and then her Bachelor of Laws degree from Osgoode Hall Law School. She was called to the Ontario Bar in February of 2002. Justice Erlick began her career as a criminal defence lawyer with the firm of Greenspan, Humphrey, Lavine. In May of 2004, she joined the Downtown Toronto Crown Attorney’s office. In November of 2017, Justice Erlick was sworn in as a judge of the Ontario Court of Justice. She presides in Toronto.

Sayeh Hassan is a criminal defence lawyer practicing with Walter Fox & Associates. She completed her Hons. BA at Carleton University in Psychology and Mass Communication and achieved an LL.B. at the University of Ottawa in 2006. She has appeared at all levels of court in Ontario and the Supreme Court of British Columbia.
