An older client may have no driver’s licence, passport or other government ID. Michael J. Lamb, J.D., discusses how lawyers can record the information available, consider alternative documents and note details a client cannot provide.

He also addresses capacity concerns through questions that invite fuller answers, written medical opinions and warning signs in the Law Society of Ontario’s capacity and undue influence risk assessment toolkit. The presentation cautions lawyers against assuming that age alone indicates a lack of capacity.
