This presentation will help lawyers understand what material they need to successfully bring a Rule 7.08 motion (i.e., what to file to have a settlement approved for a party under a disability). Justice Ray will explore the problems encountered by judges in the material that is often submitted by lawyers and why the motions are being refused. This presentation will provide guidance on the proper preparation and submission of such motion material, including considerations surrounding the evidence of litigation guardians and retainer agreements.
