Overall, this session offers a focused and practical examination of the matrimonial home in family law, bringing together six short presentations on its distinct legal status, occupation rent, designation, sale, fraudulent conveyance, and severance of joint tenancy. It highlights the statutory framework, key areas of dispute, and the practical considerations that can arise when advising clients and managing litigation.

Daniella Markov, Simply Family Law, addresses the special status of the matrimonial home in Ontario family law, highlighting how equalization, possession, and restrictions on sale or encumbrance can depart from ordinary property rules.

Amber Keegan, Kirschbaum & Co., offers a practical discussion of occupation rent, focusing on when it may be awarded, the factors courts consider, and the importance of prompt and realistic advice to clients.

Grace Foran, Cooligan Yehia LLP, speaks to matrimonial home designation, explaining how registration can provide notice, protection, and added clarity in dealings with the property.

Paige Smith, Francis Mehr LLP, reviews sale applications involving the matrimonial home, emphasizing the strong presumption in favour of sale and the limited circumstances that may justify delay.

Giselle Alexander, RPB Family Law, examines fraudulent conveyance issues affecting the matrimonial home, with attention to creditor claims, interspousal transfers, and the limits of statutory protection.

Jessica Bazor, LMS Lawyers, outlines the severing of joint tenancy of the matrimonial home, including why parties may do so and the main legal pathways for severance.
